Terms of Use Version 1.0
1. Acceptance of Terms
By accepting these Terms, you agree that they govern your use of Mindful Moods. The Privacy Policy and Medical Disclaimer provide additional information and should be reviewed with these Terms.
2. Eligibility
Mindful Moods V1 is intended only for users age 18 and older.
3. Purpose of Mindful Moods
Mindful Moods is a personal wellness and self-awareness app that helps users record experiences, review their history, notice supported relationships and patterns, recognize progress, and keep support resources accessible.
4. Medical Disclaimer
Mindful Moods is not a medical device and does not diagnose, treat, cure, prevent, or manage medical or mental-health conditions. It does not replace professional healthcare. Pattern Watch does not predict medical or psychiatric outcomes, and medication check-ins are observational wellness records only. Review Medical Disclaimer Version 3.0 for the complete limitations.
5. Free and Premium Features
Core tracking and review are Free. The full Today, History, Journal, and Progress experiences remain Free, including unlimited logging, sleep, symptoms, medication check-ins, mood reminders, emergency and Start Small resources, My Safe Place, multiple active and custom goals, the Goal Library, Healthy Habits, Journey recognition, security, encrypted manual and automatic backup and restore, custom symptom and Pattern Watch language, one active Trusted Contact, one active Professional Contact, and approved Free personalization choices. Free personalization includes up to three confirmed static backgrounds and approved Free text colors.
Free includes one partial Insight and one separate partial Pattern Watch when sufficient supported personal history is available. Premium may unlock deeper discovery content and additional supported Insights and Pattern Watches. Free does not include the entire Premium discovery experience.
Optional Premium may expand access to full and additional supported Insights, full and future supported Pattern Watches, up to three active Trusted Contacts and three active Professional Contacts, the full theme and background library, automatic time-of-day background rotation, Premium text colors, and future Premium functionality where applicable. Progress does not have a separate Premium tier in V1. Advanced Export is not designated as a locked Premium feature.
Ending Premium does not delete personal tracking records. Extra contacts remain stored but may be locked while Free, with Free contact access remaining subject to the Free limit. Premium appearance preferences remain stored while Free-eligible appearance is used. Fixed Free Insight and Pattern Watch access remains available, and viewed discovery history is not deleted merely because Premium ends. Premium-specific functionality may remain unavailable until a qualifying entitlement returns.
6. Subscriptions and Automatic Renewal
Premium is optional. The billing architecture exists, but live Google Play products and offers are not represented as currently available or release-validated by these Terms. Target U.S. prices for future Google Play configuration are:
- Monthly: $4.99 per month. Automatically renews monthly until cancelled.
- Annual: $49.99 per year. Automatically renews annually until cancelled.
The annual target is approximately two months free compared with twelve target monthly payments. If Premium subscriptions are offered, purchases, payment processing, subscription management, automatic renewals, eligibility, and cancellations are handled through Google Play and are subject to Google Play terms, policies, and applicable law. The actual localized price displayed by Google Play at checkout controls the purchase. The purchase screen must display the applicable price, billing frequency, renewal terms, and any taxes or charges handled through Google Play before enrollment.
7. Free Trials and Promotional Offers
If an eligible trial offer is made available, it may provide seven days of Premium before converting to the applicable displayed Premium price and billing period unless cancelled before conversion, subject to Google Play terms. A trial does not start automatically: the user must explicitly accept the offer through Google Play. Google Play determines commercial eligibility. A live trial is not currently represented as configured, and no trial or eligibility is guaranteed.
The offer screen must clearly disclose the trial length, post-trial price, billing frequency, automatic conversion and renewal, and how to cancel. Terms displayed when an offer is accepted control that offer.
8. Managing and Cancelling Premium
Users will manage or cancel Google Play subscriptions through Google Play. Uninstalling Mindful Moods does not cancel a subscription. Cancellation generally prevents a future renewal according to Google Play terms. Premium access may continue through the current paid entitlement period. Ending Premium does not delete personal tracking history.
9. Refunds
Purchases and refund requests are subject to Google Play's applicable policies, the terms presented at purchase, and applicable law. Where Google Play handles a refund request, Google's processes apply. These Terms neither promise refunds beyond those requirements nor prohibit refunds that Google Play or applicable law may provide.
10. Privacy
Mindful Moods is device-first and does not require a Mindful Moods account. Personal tracking history is stored locally unless the user initiates an export, backup, share, or external handoff. Review Privacy Policy Version 3.0 for details.
11. Your Content and Ownership
Users retain ownership of personal content they create or enter, including journals, mood records and notes, photos, goals, custom labels, support messages, and other personal tracking information. Gilman Creations does not acquire ownership of that content. Mindful Moods uses content locally only as technically necessary to provide functionality the user requests.
12. Backup and Backup Password Responsibility
Encrypted backup is optional and Free. The user chooses the storage location and creates a Backup Password separate from the app PIN. Mindful Moods and Gilman Creations do not know or receive the Backup Password and cannot recover an old forgotten password. Existing backups continue to require the password used when they were created.
If a user forgets a Backup Password but retains live information on a configured device, the user may create a new setup for future backups. Old backup files remain protected by the old password. If both live information and the required password are lost, Mindful Moods and Gilman Creations cannot recover that backup. Mindful Moods does not operate a cloud backup service. Users are responsible for retaining their Backup Password and backup files, and user-selected storage providers have their own terms.
Portable backup does not contain commercial Premium entitlement, purchase tokens, Google account identity, or commercial trial eligibility. Restoring Mindful Moods information does not itself restore or cancel a valid Google Play subscription; subscription access is reconciled separately through Google Play.
13. Acceptable Use
Users may not use Mindful Moods unlawfully; interfere with its operation or security; attempt unauthorized access; circumvent Premium entitlement controls; violate another person's rights; impersonate someone in a way that causes harm or fraud; or maliciously modify or distribute the app where prohibited by law. Reverse engineering may be restricted only to the extent permitted by applicable law.
14. Mindful Moods Intellectual Property
Gilman Creations retains applicable rights in the Mindful Moods software, name, branding, logos, original interface and design, original graphics and assets, written app content, educational and help material, and other protectable product materials. These Terms do not claim ownership of user content, third-party operating-system components, Google services, or licensed dependencies. Applicable third-party licenses remain in effect.
15. Third-Party Services
User-initiated functionality may open or use Google Play, Android, device speech recognition, the Phone app, SMS or messaging apps, an email application or email provider, a browser, Android sharing, Android file or storage pickers, or a user-selected storage provider. Those services are governed by their own terms and policies and are not controlled by Mindful Moods or Gilman Creations.
Feedback and support communication is voluntary. Mindful Moods prepares feedback locally, and the user reviews it before choosing whether to send it through an email application. Sending feedback does not guarantee a response, and no response time is promised. Feedback & Support is not emergency support, crisis support, medical advice, or treatment support. Emergency resources remain separate.
Users are responsible for reviewing text and attachments they voluntarily provide. Suggestions may be considered without creating an obligation to implement them. Future-testing interest does not guarantee selection or continued participation.
16. App Availability and Updates
Continuous availability, error-free operation, compatibility with every Android device, and permanent availability of every feature, external resource, or Premium benefit are not guaranteed. Gilman Creations may provide reasonable product updates, bug fixes, feature improvements, and security changes. Because personal information is device-first, users remain responsible for maintaining usable backups; Gilman Creations cannot remotely delete personal tracking information.
17. Beta Versions and Testing
If you participate in an authorized Mindful Moods Closed Beta, participation is voluntary and is intended to be fully unlocked and Free for authorized testers. Beta software may contain bugs or unfinished behavior. Participation is product testing, not medical research, and does not require disclosure of a diagnosis. No compensation or Premium reward is promised unless a separate written offer expressly says otherwise. Any Premium thank-you is discretionary and unexpected; testing activity or completion of a quota does not earn or guarantee a reward. Future-testing interest does not guarantee selection, continued participation, compensation, a Premium reward, or continued Beta access.
18. Disclaimers
To the fullest extent permitted by law, Mindful Moods is provided without warranties of uninterrupted availability, error-free operation, accuracy, completeness, fitness for a particular purpose, or compatibility with every device. Observations, Insights, Pattern Watch, Progress information, support resources, exports, reminders, and stored information may be incomplete, inaccurate, delayed, or unavailable. The Medical Disclaimer contains additional health-related limitations.
19. Limitation of Liability
To the fullest extent permitted by law, Gilman Creations and Mindful Moods developers, owners, contributors, affiliates, and representatives will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from use of, inability to use, reliance on, or interpretation of Mindful Moods. Some jurisdictions do not allow certain exclusions or limitations. In those cases, liability is limited only to the maximum extent permitted by applicable law.
20. Ending Use of Mindful Moods
Users may stop using or uninstall Mindful Moods. Uninstalling may remove locally stored information and does not cancel a Google Play subscription. Ending Premium does not delete personal tracking records. Gilman Creations does not operate a user-account system through which it remotely terminates an account or deletes personal tracking history.
21. Changes to These Terms
These Terms may change to reflect product changes, legal requirements, or improvements in clarity. An approved version will identify an Effective Date. Material future changes may require local acceptance of an updated version where appropriate. No Mindful Moods account or server is required solely to record acceptance.
22. Governing Law and Consumer Rights
These Terms are governed by applicable laws of the State of Maine and the United States, without limiting any consumer rights or protections that cannot legally be waived under laws applicable to the user. These Terms do not impose mandatory arbitration, a class-action waiver, or an exclusive venue requirement.
Automatic-renewal enrollment must separately present clear renewal terms, price, billing frequency, cancellation method, and refund policy; obtain applicable affirmative consent; provide an appropriate cancellation method; and provide any legally required renewal notice. These Terms alone do not establish compliance with Maine or other applicable subscription law.
